PRIVACY POLICY

As part of Within by NK services, I make sure I look after your personal health information. The privacy policy is all about how I do that for you.

This policy applies to your personal health information I collect about you including through my website; the App; or my social media.

If you are engaging with me, then you agree to this Privacy Policy. You should check for any updates when you are using my services or my website, the App, or my social media.

COLLECTION OF PERSONAL INFORMATION

I only collect from you the information I need to ensure I provide you with the best service. I ensure I collect your information in accordance with the laws of New Zealand.

What information am I collecting from you? I am collecting your name and contact details, your gender (including non-binary) and your date of birth, your height and weight, a bit about your home environment, what you do for work (including non-paid), specific health information which includes medical information, how you are sleeping/resting, your nutrition intake, your activity levels and what wellbeing and stress looks like for you. I ask about good and bad habits and your goals and expectations of coaching. I also collect any information you want to tell me that you think I might find useful.

I will not collect, hold, use or disclose your information other than for the purpose for which it was collected, or as otherwise required or specifically permitted by law.

I might collect your information from online pages, or surveys, or submissions you make through my website or social media. If you tag me online – I’ll be collecting your information.

When I collect your information or hold your information, I hold onto it electronically through my business address (see my contact details below) and I’ll make sure it’s only accessible by me, my employees and any authorised contractors. I will ensure anyone with access to your information has promised to keep the information confidential.

You always have a right to request access to your information and to request correction of your information. Please let me know if your details need changing – I love updates!

SITE USES AND "COOKIES"

I may gather traffic patterns into my website or other platforms (including collecting the name of the domain in which you accessed the internet; the date and time you accessed the website; and the internet address of the website from which you directly linked to the website, usage information, purchasing behaviour and such like).

Most of the time this is anonymous but just know that I may identify you if necessary and I may associate it with other personal information that I collect from you. I may share anonymous and/or aggregated statistics with others outside my business.

I use “cookies”. As a health professional this does not mean biscuits! The cookies I use are small text files placed onto your browser which help you to navigate my website easily.

SOCIAL MEDIA INFORMATION

I love hearing from people on social media. When you follow or like my social media channels or when you like, comment on, share or otherwise interact with any posts or other content on my social media channels, then I collect that information. This includes your name, profile information, profile picture and anything else you want to tell me. Be aware that these platforms are public so please don’t share any personal, confidential or sensitive information when posting on any of my social media channels, and I expect you to comply with my online terms and conditions (here)including my expectation of appropriate behaviour.

I also have a community chat option as part of my services where you can meet with others on their health and wellbeing journey with me. The same rules apply as with social media. If you want to opt out of this – let me know.

USE OF INFORMATION

As I say, I use your information to provide my services and support you.

I may share your information:
with trusted third parties in order to provide my services
if required by law
if necessary, to investigate any breach of my Terms of Use or breach of conditions of my programme
if you authorise me to do so
if I need to disclose information to prevent harm to you or someone else
in the event of a transfer or sale of some or all of my business or assets. I will only disclose your information to people who need to - know such as a prospective buyer, and I will require a confidentiality agreement from them
with anyone where you have posted in a public forum on my website, the App or social media

One of the trusted third parties involved with my business is Trainerize - TSR Gym Technik Ltd which supplies the fitness App I recommend for you to use as part of my services. I do not guarantee the security of this App or Trainerize’s compliance with privacy laws. OPTING OUT

I will be in contact with you to let you know what is happening in my business and to send out information including top tips. If you don’t want these emails, I have an “unsubscribe” option at the end of each email.

If my service to you comes to an end, then I retain your information for 10 years as required by New Zealand law. This information is held securely for that time.

SECURITY OF YOUR INFORMATION

I look after your information in a secure environment, and I take all reasonable steps to prevent loss, unauthorised access, modification or disclosure or other misuse.

No data transmission over the internet or information stored on servers accessible through the internet can be guaranteed to be fully secure. If you send me information via email or the internet, or I email or communicate with you via the internet that is at your own risk.

If you believe that your account has been accessed without your authorisation, please let me know straight away so we can get that sorted as quickly as possible.

I am committed to privacy security but if there’s a privacy breach of my system, I will investigate and contain the breach where possible. If I believe that breach has caused or is likely to cause serious harm, I will notify the New Zealand Office of the Privacy Commissioner and work with the Commissioner to address the breach. This may include letting affected people know if required.

ACCURACY

I rely on you to give me information about you that is complete, accurate, up to date, relevant and not misleading. I may need to check your information and if so, I will discuss that with you.

ACCESSING, CORRECTING, OR UPDATING YOUR INFORMATION

If you want to check your personal information, you’re more than welcome to do so.

If there’s any change to your personal information, please let me know so this can be updated. Contact me using the details below. I’ll update my records as quickly as possible. Feel free to make changes directly into any of my systems to which you have access.
